Agreement to These Terms
These Terms of Service govern access to and use of the website, client portal, and services provided by The Review Mediator (TRM, we, our, or us). By accessing our website, submitting information to us, creating an account, or using our services, you agree to be bound by these Terms. If you do not agree, do not use the website or services.
Who We Are
The Review Mediator is an Online Dispute Resolution company. We operate as an intermediary in matters involving contested online content, platform-based disputes, and related resolution processes. Our services may include intake, content review, AI-assisted analysis, policy-based assessment, dispute support, escalation strategy, mediation-oriented outreach, and ongoing case management.
No Guarantee of Removal or Outcome
You acknowledge that TRM does not own or control third-party platforms, search engines, publishers, forums, marketplaces, review sites, social media services, or content hosts. We do not guarantee that any review, post, comment, image, video, account, listing, webpage, or other content will be removed, restricted, de-indexed, modified, restored, or otherwise acted upon. Final decisions are made solely by the applicable third party.
Use of AI and Analytical Tools
As part of our services, TRM may use internal tools, third-party tools, or AI-assisted systems to help identify patterns, flag potential policy issues, organize case information, and support operational efficiency. These tools support, but do not replace, human review and judgment. TRM retains discretion over how such tools are used within its service model.
Client Responsibilities
You agree to:
- Provide accurate, complete, and lawful information
- Submit only materials you have the right to share with us
- Use our services in good faith and for legitimate business purposes
- Cooperate with reasonable requests for documentation or clarification
You agree not to:
- Use our services to submit false, fraudulent, deceptive, or bad-faith disputes
- Misrepresent facts, impersonate others, or provide fabricated evidence
- Use the website, portal, or services in a manner that violates law or third-party rights
- Attempt to disrupt, interfere with, reverse engineer, or misuse our systems
Professional Services; No Legal Advice
Unless expressly stated in a separate written agreement, TRM does not provide legal advice, legal representation, or law enforcement services. Our services are professional support services designed to help clients navigate digital disputes and resolution pathways. Any information on the website or shared during an engagement is provided for general informational and service-related purposes.
Fees and Payment
Certain services require payment under a subscription, proposal, statement of work, or other written commercial arrangement. By purchasing paid services, you agree to pay all applicable fees, charges, and taxes. Unless otherwise stated in writing, fees are non-refundable once work has begun. Failure to pay may result in suspension or termination of services.
Client Materials
You retain ownership of the materials you submit to us. By submitting content, data, documents, screenshots, links, or other materials, you grant TRM a limited, non-exclusive right to use, store, review, reproduce, and process those materials as reasonably necessary to provide services, maintain records, improve workflows, and operate our business. You represent that you have the rights and permissions necessary to provide those materials.
Confidentiality
We will use reasonable care in handling non-public information you provide. However, unless a separate confidentiality agreement is in place, nothing in these Terms creates a fiduciary relationship, attorney-client relationship, or legal privilege.
Third-Party Platforms
Our services frequently involve third-party systems and environments that we do not control. TRM is not responsible for platform decisions, policy changes, errors, downtime, account actions, publishing choices, technical failures, or other acts or omissions of third parties.
Intellectual Property
All content, branding, design, text, workflows, methods, graphics, software, and materials on our website or used in our service delivery, other than client-submitted materials, are owned by or licensed to TRM and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, publish, or exploit them without prior written consent.
Disclaimer of Warranties
To the fullest extent permitted by law, the website and services are provided on an as-is and as-available basis. TRM disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, title, and uninterrupted or error-free operation.
Limitation of Liability
To the fullest extent permitted by law, TRM will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, revenue, goodwill, data, business opportunities, or reputation, arising out of or relating to the website or services. To the fullest extent permitted by law, TRM's total aggregate liability for any claim related to the services will not exceed the amount paid by you to TRM for the specific services giving rise to the claim during the three months preceding the event giving rise to the claim.
Indemnification
You agree to defend, indemnify, and hold harmless TRM and its officers, directors, employees, contractors, affiliates, and representatives from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the website or services, your submitted materials, your violation of these Terms, or your violation of any law or third-party rights.
Termination
We reserve the right to suspend or terminate access to the website, portal, or services at any time if we believe a user has violated these Terms, failed to pay, misused the services, or created legal, operational, security, or reputational risk.
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
Dispute Resolution
Any dispute arising out of or relating to these Terms or our services will first be addressed through good-faith efforts to resolve the matter informally. If informal resolution is unsuccessful, TRM reserves the right to require resolution through binding arbitration or through the state or federal courts located in Texas, subject to any separate written agreement that governs a particular client engagement.
Changes to These Terms
We may update these Terms from time to time. Revised Terms will be posted with an updated effective date, and continued use of the website or services after that date constitutes acceptance of the updated Terms.
